Mahla Sangeet Distribution – Terms of Service & Anti-Fraud Policy

1. Introduction
Welcome to Mahla Sangeet Distribution (“We”, “Us”, or “Our”). By creating an account and using our services, you (“End User” or “You”) agree to comply with these Terms of Service, including our integrated Anti-Fraud Policy.
Our services enable End Users to distribute music to Digital Streaming Platforms (DSPs) such as Spotify, Apple Music, YouTube, Amazon Music, and others. By accessing or using our platform, you confirm that you have read, understood, and agreed to these Terms.
2. Definitions
- End User: The person or legal entity that has entered into a contractual relationship with Mahla Sangeet Distribution.
- End User Account: An account created and maintained by an End User on our platform.
- DSP (Digital Streaming Platform): Platforms such as Spotify, Apple Music, Tidal, YouTube, Amazon Music, etc.
- MDFS (Monetization through Digital Fingerprinting Systems): Systems such as YouTube Content ID, Facebook Rights Manager, etc.
- Fraud: Any activity contrary to the law, DSP policies, or our own terms, including but not limited to copyright infringement, misleading content, click fraud, artificial streaming, or unlawful use of MDFS.
- Royalties: Revenue generated from DSPs for legitimate exploitation of content.
3. User Responsibilities
- You are responsible for ensuring you have the necessary rights to all content you upload.
- You must provide accurate information in your account. Fake, misleading, or incomplete data may result in suspension.
- You may not upload copyrighted, fraudulent, or misleading content.
4. Payments & Refunds
- Subscription or per-song fees must be paid in advance.
- Payments are non-refundable except in cases of duplicate charges or technical errors.
- Refund requests must be submitted within 7 days of payment.
5. Anti-Fraud Policy
5.1 Policy Overview
Fraud in all its forms is strictly prohibited. Fraud damages artists, rights holders, DSPs, and Mahla Sangeet Distribution. Our goal is to detect, prevent, and eliminate fraudulent activities.
5.2 What DSPs Are Doing
DSPs use algorithms and human review to identify suspicious or fraudulent activity. They may remove content, block royalties, or suspend accounts involved in fraud.
5.3 What We Are Doing
We actively monitor metadata, streaming data, and account behavior to identify irregular activities. Our Quality Control (QC) processes include:
- Fingerprinting all tracks to detect duplicates, spam, or unauthorized content.
- Detecting artificial streams, click fraud, or misleading metadata.
- Reviewing artist profiles and social activity to validate growth.
5.4 Consequences of Fraud
- We may block or suspend your account.
- Royalties connected to fraudulent activity may be withheld.
- Contracts with End Users may be terminated.
- End Users may be held financially responsible for damages and legal costs.
5.5 Severity & Strike Policy
We apply a strike system based on the severity of violations:
- F0 (Critical Account Issues): Fake information, false IDs, inconsistent IP activity.
- F1 (Click Fraud / Musical Spam): Artificial streams, misleading metadata, fake growth services.
- F2 (Copyright / IP Violations): Uploading copyrighted material without authorization, impersonation of artists/labels.
- F3 (Abuse of MDFS): Manipulating Content ID, inserting content into copyrighted works.
Strike Consequences:
- Strike 1: Warning + Takedown of suspicious content.
- Strike 2: Takedown + 3-month delay on royalty payments.
- Strike 3: Account blocked + Full catalog takedown + Royalties held in escrow (24 months–5 years).
5.6 Blocked Account Policy
- Your catalog will be removed from DSPs.
- Access to services will be terminated.
- Legitimate royalties will be held in escrow for 24–60 months, per DSP and legal requirements.
- Illegitimate royalties will be returned to DSPs.
5.7 Takedowns
We reserve the right to remove any content deemed fraudulent or infringing. DSPs may also initiate takedowns independently.
6. Account Termination
We may suspend or permanently terminate accounts for:
- Violating these Terms or the Anti-Fraud Policy.
- Engaging in illegal, fraudulent, or harmful activities.
7. Limitation of Liability
Mahla Sangeet Distribution is not responsible for:
- DSP delays, rejections, or takedowns.
- Loss of royalties due to fraud, strikes, or account suspension.
- Damages arising from misuse of our platform.
8. Governing Law
These Terms shall be governed by and interpreted in accordance with applicable laws. Disputes will be resolved in accordance with the jurisdiction where Mahla Sangeet Distribution is registered.
